Demokratik Konfederasyonlar: TUTUKLANAN ATİK YÖNETİCİ VE AKTİVİSTLERİ DERHAL SERBEST BIRAKILMALIDIR

UnknownAlmanya Adalet Bakanlığının 2012 yılında verdiği izinle, haklarında soruşturma açılan 11 ATİK aktivisti 15 Nisan 2015 tarihinde eş zamanlı olarak yapılan bir operasyonla gözaltına alınıp tutuklandılar. Almanya, Yunanistan, Fransa ve İsviçre’de tutuklanan ATİK yönetici ve aktivistlerine yöneltilen suçlama; tutuklananların bazılarının  Türkiye’de TKP/ML davasından yargılanmaları, uzun süre cezaevlerinde yatmış olmaları ve Almanya’da TKP/ML adına faaliyet yürüttükleri gerekçe gösterilmektedir. Tutuklanan 7 kişi Augsburg, Münih, Kempten, Landshut, Nürmberg ve Kaisheim cezaevlerinde tek kişilik hücrelere konarak izolasyon uygulanmaktadır. Cezaevinde bulunan tutuklularla konuşmaları dahi yasaklanmış, günde sadece 30 dakika yalnız başına havalandırmaya çıkarılmaktadır. Tutuklananlar günün 23,5 saatini hücrelerde, yalnız başına geçirmektedirler. Aile görüşmeleri polisin gözetiminde, sınırlı zamanda ve camlar arkasında yapılabilmektedir. Aynı şekilde Avukat görüşmeleri de kapalı odada ve camlar arkasında yapılmaktadır ve Avukatların müvekkilleriyle yaptıkları yazışmalar kontrol edilmektedir. 
Yunanistan, İsviçre ve Fransa’da tutuklu bulunan ATİK aktivistlerinin Almanya’ya verilmesi için Alman devleti yoğun bir çaba sarf etmektedir. Musa Demir Avusturya’da oturmasına rağmen, o gün ziyaretine gittiği Dr. Sinan Aydın’ın evinde bulunduğu için tutuklanmıştır. Keza, İsviçre ve Fransa’da tutuklu bulunan iki kişinin Almanya’da oturumları bulunmadığı halde, Almanya, uluslararası hukuku çiğneyerek bu insanları alıp yargılamak istemektedir.  
Almanya’da tutuklanan Müslüm Elma, Dr. Sinan Aydın, Dr. Banu Büyükavcı, Haydar Bern, Erhan Aktürk ve Seyit Ali Uğur’un   ev ve iş adresleri belli olmasına rağmen Alman polisi adeta bir güç gösterisi yaparak, evlerin kapı ve pencerelerini kırarak içeri girmiş ve bu insanları gözaltına almıştır.
Bu operasyonun Türk ve Alman devletinin işbirliği sonucu yapıldığı açıktır. Gizli bir pazarlığın sonucu olarak gerçekleşen bu tutuklamaların perde arkasını kamuoyu eninde sonunda öğrenecektir.  Almanya son yıllarda yoğun bir şekilde bu tür operasyonları sık sık yapmış ve onlarca insan tutuklanarak 129 a-b maddesine tabi tutarak yargılamıştır. 
Tutuklananlar politik kişilerdir. Birçoğu Almanya’da iltica başvurusunda bulunduklarında politik kimliklerini gizlememiş ve devrimci olduklarını açık olarak söylemelerine rağmen, Almanya, insanların örgütlenme, politik görüşlerini yayma hakkını ihlal ederek keyfi tutuklamalara baş vurmuştur. Tutuklananlardan Müslüm Elma, Mehmet Yeşilçalı, Seyit Ali Uğur ve Sami Solmaz Türkiye’de uzun süre ceza evlerinde kalmış ve bir çok kez açlık grevi ve ölüm orucu süreci yaşayan insanlardır. Cezaevlerinde hastalıklarında dolayı Türkiye’de adli tıpın cezaevinde yatamaz raporundan dolayı serbest bırakılmışlardır.
Biz aşağıda imzası bulunan kurumlar olarak; Avrupa ülkelerinde uzun zamandır mücadele eden bir göçmen örgütü olan ATİK ile dayanışma içinde olduğumuzu belirterek, Almanya’nın 15 Nisan 2015 tarihinde gerçekleştirdiği operasyonu kınıyoruz. İzolasyon ve tecrit bir insanlık suçudur. Uluslar arası insan hakları sözleşmelerinde bunun bir işkence metodu olduğu konusunda bir çok karar söz konusudur. Almaya, tutuklanan ATİK aktivistlerine tecrit uygulayarak uluslararası sözleşmeleri çiğnemektedir. Uygulanan izolasyon kaldırılmalı ve tutuklananlar derhal serbest bırakılmalıdır.

Die festgenommenen Vorstandsmitglieder und AktivistInnen der ATIK müssen umgehend freigelassen werden!
Die elf AktivistInnen der ATIK wurden am 15. April mithilfe einer zeitgleich geführten Operation festgenommen. Die Erlaubnis für eine Ermittlung gegen diese Personen erteilte das deutsche Justizministerium bereits im Jahr 2012. Den in Deutschland, Griechenland, Frankreich und der Schweiz festgenommenen Personen wird vorgeworfen, dass manche von ihnen in der Türkei Verfahren wegen der Mitgliedschaft in der TKP/ML hätten, manche längere Zeit in der Türkei im Gefängnis gewesen seien und manche in Deutschland im Namen der TKP/ML agieren würden. Sieben der festgenommenen Personen sitzen derzeit in den Justizvollzugsanstalten in Augsburg, München, Kempten, Landshut, Nürnberg und Kaisheim in Einzelzellen und sind somit der vollkommenen Isolation ausgesetzt. Den in Haft befindlichen Personen wurde selbst das Führen von Gesprächen verboten, sie können maximal für eine halbe Stunde alleine zum Hofgang. Somit befinden sie sich 23,5 Stunden am Tag in einer Zelle und alleine. Familienbesuche finden nur unter Obacht der Polizei, für eine kurze beschränkte Zeit und hinter Glasfenstern statt. Unter den selben Umständen finden auch die Rechtsanwaltsbesuche statt und der Briefverkehr, den die/ der MandantIn zu ihrem/ seinem Rechtsanwalt pflegt, wird ebenfalls kontrolliert.
Der deutsche Staat unternimmt enorme Anstrengungen, um die in Griechenland, Frankreich und der  Schweiz in der Haft befindlichen ATIK AktivistInnen an die BRD ausliefern zu lassen. Obwohl Musa Demir in Österreich sesshaft ist, wurde er festgenommen, weil er am besagten Tag Dr. Sinan Aydin in seiner Wohnung in Nürnberg besucht hatte. Dasselbe trifft auch auf zwei weitere Personen zu, die jeweils in der Schweiz und in Frankreich wohnhaft sind. Diese möchte der deutsche Staat verurteilen. Dies wiederum zeigt, dass die BRD auf internationales Recht keinerlei Rücksicht nimmt, sondern im höchsten Maße dagegen verstoßt.
Die in Deutschland festgenommenen Müslüm  Elma, Dr. Sinan Aydin, Dr. Banu Büyükavci, Haydar Bern, Erhan Aktürk und Seyit Ali Ugur sind alle in der BRD gemeldet. Ihre Wohnsitze und Arbeitsplätze sind bekannt, doch die Art und Weise, wie sie festgenommen und ihre Wohnungen und Arbeitsplätze durchsucht wurden, sollten ganz klar einen martialischen Auftritt der Polizei zur Einschüchterung der Betroffenen und ihrer Angehörigen darstellen.
Es ist offensichtlich, dass diese Operation eine Zusammenarbeit des türkischen und deutschen Staates ist und heimliche Verhandlungen beinhaltet, doch diese werden früher oder später auch an die Öffentlichkeit drängen. Diese Art von Operationen führt der deutsche Staat in den vergangenen Jahren immer häufiger durch und Dutzende Personen mithilfe der Paragraphen 129 a und b verurteilt.
Die festgenommenen Personen sind politische Persönlichkeiten. Diejenigen, die in Deutschland einen Asylgesuch hatten, haben ihre politische Identität nicht verborgen, sondern haben ganz offen dargelegt, dass sie Revolutionäre sind. Die deutsche Regierung hat somit auf vollkommen  willkürliche Weise den Menschen ihr Grundrecht auf freie Meinungsäußerung und sich zu organisieren genommen. Die festgenommenen Müslüm Elma, Mehmet Yesilcali, Seyit Ali Ugur und Sami Solmaz sind Personen, die in der Türkei bereits mehrere Jahre im Gefängnis waren und sich an mehreren Hungerstreiks und Todesfasten beteiligt haben. Sie wurden auch nur frei gelassen, weil die Gerichtsmedizin ihre sofortige Freilassung aufgrund ihrer gesundheitlichen Situation, die eine extreme Lebensbedrohung darstellt, angeordnet hat.
Wir, als diejenigen, die diese Schrift unterzeichnen, deklarieren, dass wir uns mit der ATIK, die seit langer Zeit in Europa eine MigrantInnenorganisation ist, solidarisieren und verurteilen die Operation des deutschen Staates vom 15. April 2015. Abschottung und Isolation sind Menschenrechtsverletzungen. In der internationalen Deklaration der Menschenrechte gibt es genug Urteile, die belegen, dass dies eine Foltermethode ist. Der deutsche Staat verletzt eben diese Deklaration, indem es die AktivistInnen der ATIK  isoliert. Diese Isolation muss umgehend gestoppt und die Inhaftierten sofort frei gelassen werden!

The arrested ATIK directors and activists must be released immediately!
On 15 April 2015 in different European countries 11 ATIK activists have been arrested and taken into custody with a synchronised police operation. They had been subject to an investigation permitted by the German Ministry of Justice in 2012. Having been tried in Turkey in the TKP/ML case, having served long prison sentences and conducting activities in Germany in the name of TKP/ML are the charges against some of the activists, who have been arrested in Germany, Greece, France and Switzerland. From the detainees 7 are being kept in solitary confinement in prisons located in Augsburg, Munich, Kempten, Lansthut, Nuremberg and Kaisheim. Even talking to the other inmates in the prisons is prohibited and they are allowed to spend only half an hour out of their cells, on their own. The detainees spend 23.5 hours of the day in their cells of isolation. Family visitors can only be met under the supervision of the police officers, for a very limited time and separated by a glass panel. The meetings with their lawyers happen likewise in closed rooms behind glass separators. The correspondence of the lawyers with their clients is monitored by the police.
The German state makes huge efforts for the ATIK activists detained in Greece, Switzerland and France to be transferred to Germany. Musa Demir was arrested while he was visiting Dr Sinan Aydin in his house on that day despite the fact that Musa Demir officially resides in Austria. Moreover, 2 activists who are detained in Switzerland and France are wanted by Germany even though they do not have residence permits for Germany. The German state wants to try these activists while trembling on the international law.  
Despite the fact that the home and work addresses of Müslüm Elma, Dr. Sinan Aydın, Dr. Banu Büyükavcı, Haydar Bern, Erhan Aktürk and Seyit Ali Uğur were known to the authorities, the German police, with a show of force, raided their houses by breaking down the doors and windows and arrested them. 
It is clear that these operations have been conducted with cooperation by the Turkish and German states. Sooner or later the public will find out the true reasons of these arrests, which happened as a consequence of a secret deal between the Turkish and German authorities. During the recent years the German state has intensively executed such operations, arrested people and tried them based on the sections 129a and 129b of the German Criminal Code, which deal with “terrorist organisations”!
Those arrested are political people. Many of them had not concealed their political allegiances and had openly declared that they were revolutionaries when they sought political asylum in Germany. Nevertheless the German state has violated the right to organise and the right to political opinion of these people and has resorted to arbitrary arrests. The detainees Müslüm Elma, Mehmet Yeşilçalı, Seyit Ali Uğur and Sami Solmaz had served long prison sentences in Turkey and they are people who had participated at hunger strikes. Due to their illness they were released on compassionate grounds mandated by the Institution of Forensic Medicine in Turkey.
We, the organisations with their signatures below, declare our solidarity with ATIK, an organisation of migrants with a long legacy of struggle in the European countries. We condemn the operations carried out by the German state on 15 April 2015. Isolation in prisons is a crime against humanity. There are many articles in international human rights conventions that solitary confinement is a method of torture. The German state is violating the international conventions by keeping the ATIK activists in solitary confinement.
The isolation has to end now and the detainees must be released immediately.

LES DIRIGEANT-E-S DE L’ATIK ET SES MILITANT-E-S DOIVENT ËTRE IMMEDIATEMENT LIBERE-E-S !!
Avec l’autorisation donnée par le Ministère de la Justice allemande en 2012, 11 activistes de l’ATIK, contre lesquels une enquête avait été ouverte, ont été arrêté-e-s, mis-es en garde à vue puis emprisonné-e-s lors d’une opération. Les dirigeant-e-s et activistes de l’ATIK, arrêté-e-s en Allemagne, en Grèce, en Suisse et en France, sont suspecté-e-s d’appartenir au TKP/ML, depuis les procès lors de l’affaire TKP/ML suite auxquels ils avaient été emprisonné-e-s un long moment en Turquie. Certains sont, en plus, accusé-e-s de diriger des activités du TKP/ML en Allemagne. 7 d’entre eux sont maintenu-e-s en isolations et ont été séparé-e-s dans les prisons de  Augsburg, Münih, Kempten, Lansthut, Nürmberg et Kaisheim. Ils n’ont pas le droit d’avoir de contacts avec les autres prisonniers et ne peuvent sortir prendre l’air que 30 minutes par jour. Ils passent donc 23h et 30 minutes par jour confinés dans leurs cellules. Les visites des membres de leur famille ne sont autorisées que de manière limitée, sous le regard d’un gardien et à travers un parloir. De la même manière les rencontres avec leurs avocats se font dans des pièces fermées et à travers un parloir. De plus, les compte rendus des entrevus sont systématiquement contrôlées.
L’Allemagne, responsable des opérations en Europe, fait des demandes insistantes pour l’extradition des prisonniers qui sont en France, en Grèce et en Suisse. L’un des prisonniers, Musa Demir a été arrêté en Allemagne parce qu’il était en visite chez le Dr. Sinan Aydın, autre interpellé, alors même qu’il réside en Autriche. L’Allemagne réclame sans considération pour la loi internationale, deux autres détenus, l’un en Suisse et l’autre en France, sans qu’ils soient citoyens allemands.
En Allemagne, lors de l’opération, les maisons de  Müslüm Elma, Dr. Sinan Aydın, Dr. Banu Büyükavcı, Haydar Bern, Erhan Aktürk et Seyit Ali Uğur, ont été prises d’assaut, portes fracassées, fenêtres brisées. Cette démonstration de force n’avait pour but que d’impressionner car les adresses des habitations et des lieux de travails des interpelé-e-s étaient déjà connus des services de police.
Il est clair que la finalité de cette opération est le résultat de la coopération entre les Etats turc et allemand. L’opinion publique doit comprendre que ces arrestations sont, donc, le fruit de négociations secrètes. Ces dernières années, l’Allemagne a procédé, de manière intense, à ce genre d’opérations contre des dizaines de personnes poursuivies par lois 129 a-b.
Les personnes arrêté-e-s sont des représentant-e-s politiques. Lorsqu’ils ont demandé le droit d’asile, ils n’ont pas caché leurs identités politiques ni qu’ils étaient révolutionnaires. Malgré cela, l’Allemagne a procédé à  des arrestations arbitraires violant leur droit d’organisation et de partager leurs idées politiques. Les détenus  Müslüm Elma, Mehmet Yeşilçalı, Seyit Ali Uğur et Sami Solmaz sont des personnes ayant déjà été emprisonné de longues périodes dans les prisons turques, et ont plusieurs fois menés des grèves de la faim, approchant même de la mort. C’est seulement suite à la dégradation de leur santé qu’un rapport stipulant qu’ils ne pouvaient plus vivre enfermé les fit sortir.
En tant qu’organisations dont les signatures se trouvent en bas de ce texte, nous déclarons être solidaires avec l’ATIK, qui est une organisation qui lutte depuis longtemps pour les droits des immigrés en Europe. Nous condamnons les opérations d’arrestations du 15 avril 2015 orchestrées par l’Allemagne. Nous déclarons que la séparation et l’isolement, que subissent nos camarades, sont des crimes contre l’humanité. Selon les accords internationaux des Droits de l’Homme, plusieurs décisions condamnent ces pratiques comme étant des méthodes de tortures. En appliquant l’isolement aux activistes de l’ATIK en prison, l’Allemagne foule au pied ces accords internationaux. Nous réclamons au plus vite l’arrêt de l’isolation des détenus, et leurs libertés immédiates.
