Saibaba Posters INGGERMANY | 05.25.2014 | Gokarakonda Naga Saibaba , an activist and academic, is located in the central prison of Nagpur in Maharashtra in custody. His legs are almost completely paralyzed and he is in a wheelchair. Medicines and access to appropriate sanitation are denied.

The 47-year-old Gokarakonda Naga Saibaba is an activist and professor of English at the University of Delhi. He openly criticized human rights violations by security forces fighting against armed groups in Central India. On May 9, Gokarakonda Naga Saibaba was arrested in Delhi from Polizeibeamt_innen and flown to Nagpur in Maharashtra, where transferred him to a local court on May 23, 2014 in detention.

He is among the most important anti-terrorism law of India, the Law on the Prevention of Crime (Unlawful Activities Prevention Act – UAPA), on suspicion of involvement in crime, membership in and support a terrorist organization and conspiring with the aim of committing terrorist acts recorded.

As a consequence of polio both legs of Gokarakonda Naga Saibaba are paralyzed and he is in a wheelchair. He also suffers from heart disease and high blood pressure and must be regularly treated with medication. His lawyer told Amnesty International that the prison authorities that prevented his family to bring him drugs that are necessary for its treatment. Furthermore Gokarakonda Naga Saibaba denied, according to the lawyer, access to adequate sanitation in prison.

The UAPA used non-specific and overly broad definition of „terrorist acts“ and „membership“ in „unlawful“ organizations and is contrary to the international legal obligations of India.

BACKGROUND INFORMATION

Since 2005, a number of activists and human rights defenders have been falsely accused and imprisoned because they have pointed to the human rights situation in the region in central India.

Among them are Binayak Sen of the People’s Union for Civil Liberties (People’s Union for Civil Liberties); Kartam yoga, a member of the indigenous people of the Adivasi and a leading member of the Communist Party of India; Adivasi activists Soni Sori and Lingaram Kodopi and Prashant Rahi, a journalist and activist.

Human rights groups in India have several cases are highlighted where the UAPA was used improperly using fabricated evidence and false accusations to activists who defend the rights of the communities of the Adivasi and Dalit and make the peaceful exercise of their rights to freedom of expression and freedom of association use, to imprison.

Parts of the UAPA not comply with international human rights standards and have a high probability to human rights violations. In 2008, the minimum period of detention for suspects was extended through amendments to the Law of 15 to 30 days and the maximum duration of the detention of 90 to 180 days. Moreover, these changes underwent adequate safeguards against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment prisoner before her trial, returned certain types of burden of proof for serious offenses and written before that the accused had to prove their innocence in certain circumstances.
