Resolution of the International Symposium

 Against wars, martial-and anti-terror laws and against growing state-terrorism! For democracy and the right of self-determination of the people, the right of liberation and international resistance!

On Saturday February 20th 2016 a vigorous and successful international symposium about the critic of the political judiciary was held at the “Villa Leon” in Nürnberg, Germany.

The organizers and participants of this event revert their political-juridical critics against law enforcement motivated by external-and power political interests under the §§ 129, 129a and 129b of the German Criminal Code (StGB). Also they discussed the justified struggle against repression and the international right of resistance like the example of 9 left, political immigrant activists from Turkey living in Europe that face a current criminal proceeding.

Initiators of this event are the International Association of Peoples Lawyers (IAPL), the German-Kurdish Association for Democracy and International Law (MAF-DAD). The event was carried from the legal aid foundation for Kurdish People in Germany (AZADÎ), Rote Hilfe (Red Aid), and the Immigrant Organisation ATIK (Confederation of Workers from Turkey in Europe).

The reason for this joint event was the outermost repressive procedure of the German politics and judiciary against left Turkish and Kurdish organisations. For example the ministry of Justice and Consumer Protection (BMJV) gave the permition to observe so called leaders and members of the “Communist Party of Turkey/Marxist-Leninist” (TKP/ML), this party is not prohibited in Germany and is not listed in the anti-terror list. In these arrestment’s we can see a new form of trying to criminalize all progressive, democratic and revolutionary forces worldwide.

Since April 2015 nine in Germany living political individuals are held in detention in various prisons in Bavaria. Another person that was arrested in Switzerland is about to be extradited to Germany for the same accusations. All of them are accused to be member in a so-called “foreign terrorist organization” (§129b StGB).  According to a statement from January 26th the Federal German Bar (BAW) has preferred charges against nine suspects for the higher regional court in Munich.

The activists are accused inter-alia that they have taken place, since 2007, in “common attacks with the fighting force of the PKK against the Turkish state”. Repressions and prosecution against the Kurdish liberation movement is practised since November 1993 when the Federal department of internal affairs released an interdiction.

In the last years many of their political activities were stigmatised as either criminal or terrorist or even both-irrespective of any structural or political new orientation.  More than 150 Kurdish activists have been imprisoned according to the §129, 129a, 129b (StGB). Currently there are eight political Kurdish prisoners in detention or prison.

The permanent political conflict in the unsolved Turkish-Kurdish question which solution was close a couple of years ago, but than was defeated again in Summer 2015 when the AKP regime started a new offensive and brutality through direct and indirect state terror. The military escalation and the resulting effects of human rights violations from the Turkish security forces in the Kurdish provinces happens in front of the international world public. But these realities and facts do not stop the prosecution authorities in Germany to change their practice against Kurdish and Turkish Freedom fighters and left opponents. More then ever the Turkish state can trust the political support of the EU and Germany.

The aim of this symposium is it to enlighten the reasons of the political motivated prosecution and repression against left migrants from Turkey and Kurdistan, especially in Germany. The dramatically developments in the NATO-partner country Turkey, for which the fascist regime in Ankara under the leadership of the AKP is responsible and the war against the Kurdish civilians and the democratic-revolutionary movement but also the “dirty deals” with the EU and Ankara about the “refugee question” gave the participants of the symposium the opportunity for intense discussions and political consistence. The current political support from EU and Germany for the Turkish state was criticised and rejected.

The more than 200 participants and supporters of the international symposium declared their solidarity with political prisoners worldwide. In this sense we are in solidarity with the political revolutionary prisoners Prof. Dr.G.N. Saibaba (India), Mumia Abu Jamal (US), Abdullah Öcalan (Turkey), Müslüm Elma (Germany) and thousands more. These persons, representatives and examples of the international resistance right and global liberation struggles have fundamental rights of the pursuit of happiness, free live, self- determination and freedom of speech.

The participants strongly condemn the on going destructive war condition in the near and middle East these conflicts are created by the imperialist powers to secure their economical and geo political interests.  As a sign of rejection of these policies that are based on exploitation, destruction and violence, the participants of the symposium have defined the solidarity and international common work of all progressive forces and see the following steps as necessary:

  • immediate release of all Kurdish and Turkish and other imprisoned fighters of the international liberation movement worldwide!
  • abolition of all martial-and anti-terror laws, which legalize state-terrorism and that serve the annihilation of democracy.
  • abolition of the paragraphs 129, 129a, 129b of the German Penal Code (StGB).
  • immediate withdrawal of the persecution authorisation according to § 129b (StGB) of the BMJV and a closing of the political motivated proceedings.
  • annulment of the PKK-ban and the cancelation of the PKK and all other liberation movements and revolutionary organisations from the EU Terror list.
  • immediate release for Mumia Abu Jamal, Abdullah Öcalan, Prf. Dr. G.N. Saibaba, Müslüm Elma and all other political, progressive revolutionary prisoners.

The right of resistance is the right of Freedom!

Where right becomes unjust, resistance becomes responsibility!
